TO: School Administrators FROM: Gerri Ogle, Associate Commissioner DATE: April 4, 2008 SUBJECT: Debarment Notice - IBM The Department of Elementary and Secondary Education (DESE) has learned that IBM has been suspended from receiving new federal contracts and certain other award instruments under federal Executive Order 12549 (Debarment and Suspension). IBM is now on the Excluded Parties List System (EPLS) maintained by the General Services Administration. The EPLS website is http://epls.gov. While the suspension stems from action taken by the Environmental Protection Agency, it applies throughout the Federal Government. The suspension is also applicable to federal assistance provided to grantees and subgrantees. Consequently, DESE is advising you, as subgrantees of federal funds, that new contracts, renewed contracts, or extended contracts with IBM are prohibited at this time. You are not required to terminate contracts and agreements already in effect. Please remember that contracts paid with any federal money need to include the following clause: “The contractor certifies that it and its principals are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal Department or Agency.” Please contact School Finance at 573-751-0357 if you have questions on this issue.
