Subject: Parental Rights Statement and Notices of Action Source: CJ Hubbard, Assistant Director, Part C Compliance Intended Audience: SPOEs, Service Coordinators Date: September 4, 2007 The Parental Rights Statement, Notice of Action/Consent and Notice of Action forms are now available in the following languages:
Part C regulations implementing IDEA require the Parental Rights Statement be given to the parent with Notices of Action, and that written notices be given to the parent when proposing or refusing to initiate or change the identification, evaluation, placement of the child, or provision of early intervention services to a child and family, in their native language (meaning the language or mode of communication normally used by the parent). Once service coordinators have determined the parent’s native language, they should arrange for the service provider/interpreter to complete the pertinent sections of the applicable notice in the native language. If the notice is not available in the parent’s native language the service coordinator should arrange to have the notice read to the parent by a translator/interpreter.
