Section-by-Section Analysis
SB 944

160.261.2 – Adds to the list of criminal acts that must be reported by school officials to law enforcement the crimes of child molestation in the first degree (section 566.067), deviate sexual assault (section 566.070) and sexual misconduct (section 566.083).  

160.261.3 - Clarifies that provisions of the gun-free schools act applies to bringing a weapon to all areas of the school and to school activities.

 160.522 - Requires the state board of education to include in the local district public reporting model suspensions longer than ten (10) days and expulsions.  Deletes outdated implementation date for the reporting model.

 160.660 - Requires that the state board of education include a school facilities and safety criteria to the Missouri School Improvement Program.

 160.700 - Creates a pilot program for public middle school students using military training and motivation methods.  Creates the “National Guard Pilot Instruction Program Fund to receive grants, donations and appropriations for operating the program.

 161.650.1 - Amends the existing mandate for a violence prevention program by requiring the department of elementary and secondary education to adopt a program and to allow the content of that program to expand beyond the topic areas listed in the statute.

 161.650.2 - Deletes outdated implementation date for program implementation.

 161.650.3 – Amends the authorization for program grants to provide for implementation upon determination that the categorical add-on for school safety provided under 163.031.3 under the bill is insufficient to implement local district programs.

 163.031.3 - Creates a categorical add-on for school violence prevention programs.

 165.011 - Authorizes an additional transfer for school districts to be made from the Incidental Fund to the Capital Projects Fund.  The purpose of this transfer is for school safety and security purposes.

 165.016 - Excludes school safety and security expenditures from the certificated salary compliance calculation.

 167.020.1, .4 & .5 - Allows military-issued guardianships to be used for purposes of student residency requirements under the Safe Schools Act.  Current law would allow recognition of only court-ordered guardianships.

 167.020.7 – Amends the timeline for school districts to request student records from 48 hours to two business days after enrollment.  Aligns the standards for access to student records with the provisions of the federal Family Educational Rights and Privacy Act (FERPA) and allows school districts to disclose student records to law enforcement and juvenile authorities consistent with FERPA.   

167.023 – Amends the requirement of parental disclosure of prior student expulsions relating to weapons, alcohol, drugs or willful injury to another.  Includes expulsion from public and private schools.

 167.115.1 - Adds to the list of criminal acts that must be reported to school officials for conduct outside of school to include the crimes of child molestation in the first degree (section 566.067), deviate sexual assault (section 566.070) and sexual misconduct (section 566.083).   Expands the list of mandated reporters from just juvenile officers to include sheriff, chief of police or other appropriate law enforcement authority.  

 167.115.2 – Requires a second notification to school officials upon disposition of the cases under 167.115.1.

 167.115.3 – Amends the current restriction on use of the notification under 167.115.1 as the sole basis for denying education services to the student so that it applies only to public schools. 

 167.115.6 – Provides that the notice received under 167.115.1 shall be forwarded to subsequent schools in which the student seeks enrollment.   

167.115.7 - Provides that non-public schools, along with the other responsibilities under the section, shall receive the notice provided under 167.115.1.  Provides good faith immunity to officials reporting information under the section.

167.117.2 - Clarifies the provisions of the safe schools act requiring notice by school officials to law enforcement of any incident in which a student is found in possession of a weapon or a controlled substance so that it applies to all areas of the school and to school activities.

 167.117.4 – Expands the good faith immunity granted to school officials making reports under this section to include reports to law enforcement and juvenile authorities.

 167.171.3 – Current law provides that a public school may not enroll a student suspended for 10 days for an action of school violence or some other disciplinary matter from a public school without holding an admission conference.   This requirement is amended to apply to both public and private school suspensions for more than 10 days for an act of school violence.   

167.171.4 - Current law provides a process by which a public school district may recognize student disciplinary actions of another school district in the state.  The law is amended to allow recognition of those actions whether taken by a district in-state or out-of-state, in a public, private or charter school.

 170.250 - Establishes a funding floor for the Video Instructional Development and Educational Opportunity Fund of at least $4.0 million.

 210.865 - School districts would be authorized to coordinate their information systems to allow sharing of information regarding children tracked by certain state agencies including circuit courts, social services, health and mental health.

 475.060 - Authorizes appointment of a guardianship for school registration and medical insurance coverage. 

 475.070 – Amends the requirement of service for the appointment of a guardianship for school registration and medical insurance coverage.  

569.155 – Creates the crime of trespass of a school bus.

 571.030 – Adds to the crime of unlawful use of a weapon carrying a firearm into a school, onto a school bus or to a school activity.  Provides an exception for possession of a weapon in a vehicle used to drop off or pick up a student from school or if the weapon is present for a school-sanctioned activity. 

 574.150 – Creates the crime of terroristic threat for knowingly making a false report concerning the occurrence of any catastrophe.

 Section 1 – Creates within the department of elementary and secondary education a four-year competitive grant program for student suicide prevention.
